欢迎您使用本应用（以下简称“本应用”）。
本应用由苏州姑苏区三言智能信息技术工作室提供并运营。请您在使用本应用前仔细阅读并充分理解本《用户服务协议》（以下简称“本协议”）。一旦您下载、安装、注册、登录、访问或使用本应用，即表示您已阅读、理解并同意接受本协议的全部内容。
如您不同意本协议的任何内容，请立即停止使用本应用。
1. 服务内容
本应用为英语学习辅助工具，主要功能包括：
（1）用户上传图片；
（2）本应用对图片及相关内容进行必要的内容安全审核；
（3）图片在审核通过后，可能会被发送至第三方 AI 服务进行处理；
（4）第三方 AI 服务根据图片内容生成三句英文描述及相应翻译或学习内容；
（5）本应用将生成结果展示给用户，用于英语学习、表达练习和个人记录；
（6）在您授权或使用相关功能的情况下，本应用可能保存您的历史记录，以便您后续查看。
本应用旨在帮助用户将个人生活经历、照片记忆与英语学习结合，提升语言学习兴趣和效率。本应用不属于新闻、社交、医疗、法律、金融、教育培训资质认证或其他专业服务工具。
2. 用户账号
本应用支持通过邮箱注册和登录账号。您应妥善保管账号信息、登录密码、验证码及其他登录凭证，并对通过您的账号进行的全部操作承担责任。
如您选择不登录账号，本应用的部分功能可能仍可使用，但您的使用次数、购买记录、历史记录、云端同步、数据恢复等功能可能受到限制。未登录状态下产生的数据，可能仅保存在当前设备本地，卸载应用、更换设备、清除数据或系统异常可能导致数据丢失。
如您登录账号，本应用可能为您提供跨设备同步历史记录、使用次数、购买记录或其他权益的功能。具体功能以应用内实际提供为准。
3. 用户行为规范与内容安全
您承诺在使用本应用时遵守法律法规、公序良俗、本协议约定以及第三方服务平台规则，不得上传、输入、生成、保存、传播或以其他方式使用包含以下内容的图片、文字或其他信息：
（1）反对宪法所确定的基本原则的；
（2）危害国家安全、泄露国家秘密、颠覆国家政权、破坏国家统一的；
（3）损害国家荣誉和利益的；
（4）歪曲、丑化、亵渎、否定英雄烈士事迹和精神的；
（5）宣扬恐怖主义、极端主义、暴力、血腥、犯罪活动的；
（6）宣扬淫秽、色情、低俗、赌博、毒品、迷信等违法违规内容的；
（7）侮辱、诽谤、威胁、骚扰他人，或侵犯他人名誉权、肖像权、隐私权、知识产权及其他合法权益的；
（8）包含他人身份证件、联系方式、住址、人脸、医疗、财务、账户凭证等隐私或敏感信息，且未经合法授权的；
（9）涉及未成年人不适宜内容，或可能损害未成年人身心健康的；
（10）以规避、对抗、测试、破坏内容安全机制为目的的内容或行为；
（11）其他法律法规、监管要求、本应用规则或第三方服务平台规则禁止的内容。
您不得利用本应用从事任何违法违规、侵权、骚扰、攻击、批量滥用服务、干扰本应用正常运行或损害本应用、其他用户、第三方服务提供方合法权益的行为。
4. 内容审核与违规处理
为保障服务安全、履行合规要求并维护正常服务秩序，本应用有权对用户上传的图片、输入内容、AI 生成内容及相关使用行为进行自动化或人工审核。审核方式可能包括但不限于使用第三方内容安全服务、关键词识别、图像识别、日志风控、人工复核等。
如本应用发现或合理判断您上传、输入、生成、保存或传播的内容存在违法违规、侵权、违反公序良俗、违反第三方服务平台规则或其他不适宜情形，本应用有权根据具体情况采取以下一种或多种措施：
（1）拒绝处理相关图片或内容；
（2）不生成、隐藏、删除或限制展示相关结果；
（3）中止或限制您的部分或全部功能使用；
（4）删除相关历史记录或用户数据；
（5）冻结、限制或终止您的账号；
（6）依法向有关主管部门报告或配合调查；
（7）法律法规、本协议或平台规则允许的其他处理措施。
如您的违法违规行为导致本应用、运营主体、其他用户或第三方服务提供方遭受损失、投诉、处罚、索赔、服务限制或账号处罚，您应自行承担相应责任。
5. AI 生成内容说明
本应用中的英文描述、中文翻译及其他相关内容由人工智能模型自动生成，仅供语言学习、表达练习和参考使用。
AI 生成内容可能存在不准确、不完整、不恰当、与图片内容不完全一致或不符合用户预期的情况。本应用不保证 AI 生成内容的准确性、完整性、合法性、适用性或特定用途可用性。
用户应自行判断并合理使用 AI 生成内容，不得将 AI 生成内容用于违法违规、侵权、商业误导、专业决策或其他不适当用途。
如 AI 生成内容存在违法违规、侵权、不适宜或其他风险，本应用有权不予展示、删除、限制访问或采取其他必要措施。
6. 第三方服务
为实现图片识别、内容生成、内容安全审核、数据存储、登录认证、支付结算等功能，本应用可能接入第三方服务，包括但不限于 AI 模型服务、内容安全审核服务、云存储服务、账号登录服务、应用内购买服务等。
您理解并同意，您上传的图片、输入内容、AI 生成内容及必要的设备、日志、账号、订单等信息，可能会在实现上述功能所必需的范围内传输至相关第三方服务提供方进行处理。
您不得通过本应用向第三方 AI 服务或其他第三方服务提交违法违规、侵权、色情低俗、暴力恐怖、涉政敏感、侵犯他人权益或违反第三方平台规则的内容。因您违规使用导致第三方服务限制、暂停、终止本应用相关服务，或导致本应用、运营主体承担责任的，您应自行承担相应后果。
第三方服务由相应第三方提供并承担责任。第三方服务的可用性、稳定性、安全性、处理规则、服务条款及隐私政策可能由第三方独立决定。本应用将在合理范围内选择合适的第三方服务，但不对第三方服务的持续可用性或处理结果作绝对保证。
7. 使用次数、购买与付费服务
本应用可能提供免费使用次数、消耗型应用内购买、会员或其他付费服务。具体价格、权益、有效期、使用规则以应用内展示及 Apple App Store 购买页面为准。
如本应用提供消耗型应用内购买，购买后通常用于增加可使用次数或兑换相应服务。消耗型购买项目一经消耗，通常无法恢复。未登录状态下购买或使用可能导致购买记录、剩余次数、历史记录无法跨设备同步或在卸载应用后恢复。
如您通过 Apple App Store 购买相关服务，支付、退款、账单、税费等事项通常由 Apple 根据其规则处理。您应遵守 Apple 的相关服务条款和支付规则。
因网络异常、第三方服务故障、应用商店订单延迟、用户设备异常等原因导致权益发放或显示异常的，您可以通过本协议载明的联系方式与我们联系，我们将在核实后尽力协助处理。
8. 用户上传内容与知识产权
用户上传的图片及其中包含的合法权益，归用户或原权利人所有。本应用不会因您上传图片而取得该图片的所有权。
为实现本应用功能，您授予本应用在提供服务所必需范围内，对您上传的图片、输入内容和生成结果进行存储、传输、处理、展示、生成、审核和同步的权利。
您应确保您上传、使用的图片及相关内容拥有合法来源或必要授权，不侵犯任何第三方的肖像权、隐私权、名誉权、著作权、商标权、个人信息权益或其他合法权益。因您上传或使用相关内容引发的争议、投诉、索赔或法律责任，由您自行承担。
本应用的名称、界面、设计、文字、图形、代码、功能逻辑、商标、标识及其他由运营主体提供的内容，除依法归属于第三方的部分外，相关知识产权归运营主体或相应权利人所有。未经许可，您不得复制、修改、传播、出租、出售、反向工程或以其他方式使用本应用内容。
9. 数据保存与删除
本应用可能保存您上传的图片、AI 生成内容、历史记录、账号信息、使用次数、订单记录、日志信息等数据，以便提供核心功能、历史记录查看、账号同步、订单核验、内容安全和服务稳定性保障。
您可以在应用内使用删除功能，或通过本协议载明的联系方式请求删除相关数据。我们将在核实您的身份和请求后，在合理期限内处理，但法律法规另有规定、履行合规义务、处理争议、保障安全或保留必要记录的情形除外。
如您删除账号，本应用将按照隐私政策及应用内说明处理与账号相关的云端数据。账号删除后，相关云端历史记录、同步数据、部分权益或服务可能无法恢复。保存在您设备本地的数据，可能需要您自行在设备中删除或卸载应用清除。
10. 服务中断、变更与终止
本应用可能因产品调整、技术维护、系统升级、网络故障、第三方服务变化、法律法规或监管要求等原因，变更、中断、限制或终止部分或全部服务。
我们会在合理范围内尽量保障服务稳定，但不保证服务不会中断、不会出错或始终满足您的全部需求。
如您违反本协议、法律法规或第三方服务规则，本应用有权限制、暂停或终止向您提供服务，并视情况采取本协议约定的处理措施。
11. 免责声明
本应用按“现状”和“可用”状态提供。除法律法规另有明确规定外，本应用不对服务的连续性、准确性、完整性、及时性、安全性、适用性或无错误作任何明示或默示保证。
您理解并同意，因以下原因导致的损失或风险，本应用在法律允许范围内不承担责任：
（1）用户自行上传、使用、传播违法违规、侵权或不适宜内容；
（2）AI 生成内容不准确、不完整、不恰当或不符合预期；
（3）用户误用、依赖或不当使用 AI 生成内容；
（4）用户设备、网络、系统、账号、应用商店或第三方服务异常；
（5）不可抗力、监管要求、法律法规变化或其他非本应用可合理控制的原因。
12. 未成年人使用
本应用不主动面向未满 14 周岁的儿童提供服务。未成年人使用本应用的，应在父母或其他监护人的同意和指导下使用。
监护人应合理引导未成年人正确、安全地使用本应用，并对未成年人使用本应用的行为承担监护责任。如您是未成年人，请勿上传包含自己或他人隐私、敏感信息或不适宜内容的图片。
13. 协议修改
我们可能根据产品功能、法律法规、监管要求或运营需要修改本协议。协议更新后，我们会通过应用内提示、页面公告或其他合理方式告知用户。
如您在协议更新后继续使用本应用，即视为您已阅读、理解并同意接受更新后的协议。如您不同意更新内容，请停止使用本应用。
14. 法律适用与争议解决
本协议的订立、履行、解释及争议解决，适用中华人民共和国法律法规，但不包括冲突法规则。
因本协议或使用本应用产生的争议，双方应首先友好协商解决；协商不成的，任何一方可依法向有管辖权的人民法院提起诉讼。

Terms of Service
Welcome to this application (the “App”).
The App is provided and operated by Suzhou Gusu District Sanyan Intelligent Information Technology Studio. Please read and fully understand these Terms of Service (the “Terms”) before using the App. By downloading, installing, registering, logging in to, accessing, or using the App, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree to any part of these Terms, please stop using the App immediately.
1. Service Content
The App is an English learning assistant. Its main features include:
(1) users upload images;
(2) the App conducts necessary content safety review on images and related content;
(3) after passing the review, images may be sent to third-party AI services for processing;
(4) the third-party AI service generates three English descriptions and corresponding translations or learning content based on the image;
(5) the App displays the generated results for English learning, expression practice, and personal record keeping;
(6) with your authorization or when you use relevant features, the App may save your history records so that you can view them later.
The App is intended to help users combine personal life experiences and photo memories with English learning. The App is not a news, social networking, medical, legal, financial, professional education certification, or other professional service tool.
2. User Account
The App supports account registration and login by email. You should properly safeguard your account information, login password, verification codes, and other login credentials, and you are responsible for all activities conducted through your account.
If you choose not to log in, some features may still be available, but your usage quota, purchase records, history records, cloud synchronization, data recovery, and other features may be limited. Data generated while not logged in may only be stored locally on the current device. Uninstalling the App, changing devices, clearing data, or system errors may result in data loss.
If you log in, the App may provide cross-device synchronization of history records, usage quota, purchase records, or other benefits. The specific features are subject to the actual functions provided in the App.
3. User Conduct and Content Safety
You undertake to comply with laws and regulations, public order and good morals, these Terms, and rules of third-party service platforms. You must not upload, input, generate, save, distribute, or otherwise use images, text, or other information containing any of the following:
(1) content that violates the basic principles established by the Constitution;
(2) content that endangers national security, leaks state secrets, subverts state power, or undermines national unity;
(3) content that harms national honor and interests;
(4) content that distorts, defames, desecrates, or denies the deeds and spirit of heroes and martyrs;
(5) content that promotes terrorism, extremism, violence, gore, or criminal activities;
(6) content that promotes obscenity, pornography, vulgarity, gambling, drugs, superstition, or other illegal or non-compliant content;
(7) content that insults, defames, threatens, or harasses others, or infringes upon others’ reputation rights, portrait rights, privacy rights, intellectual property rights, or other lawful rights and interests;
(8) content containing another person’s identity documents, contact information, address, face, medical information, financial information, account credentials, or other private or sensitive information without lawful authorization;
(9) content inappropriate for minors or content that may harm the physical or mental health of minors;
(10) content or behavior intended to bypass, challenge, test, or undermine content safety mechanisms;
(11) other content prohibited by laws and regulations, regulatory requirements, App rules, or third-party service platform rules.
You must not use the App for any illegal, non-compliant, infringing, harassing, attacking, bulk-abusive, service-disrupting, or other activities that harm the legitimate rights and interests of the App, other users, or third-party service providers.
4. Content Review and Handling of Violations
To ensure service safety, fulfill compliance obligations, and maintain normal service order, the App has the right to conduct automated or manual review of user-uploaded images, input content, AI-generated content, and related usage behavior. Review methods may include, but are not limited to, third-party content safety services, keyword recognition, image recognition, log-based risk control, and manual review.
If the App discovers or reasonably determines that any content uploaded, input, generated, saved, or distributed by you is illegal, non-compliant, infringing, contrary to public order and good morals, in violation of third-party platform rules, or otherwise inappropriate, the App may take one or more of the following measures:
(1) refuse to process the relevant image or content;
(2) refuse to generate, hide, delete, or restrict display of relevant results;
(3) suspend or restrict your access to some or all features;
(4) delete relevant history records or user data;
(5) freeze, restrict, or terminate your account;
(6) report to competent authorities or cooperate with investigations in accordance with law;
(7) take other measures permitted by laws and regulations, these Terms, or platform rules.
If your illegal or non-compliant behavior causes losses, complaints, penalties, claims, service restrictions, or account penalties to the App, the operator, other users, or third-party service providers, you shall bear the corresponding responsibility.
5. AI-Generated Content
The English descriptions, Chinese translations, and other related content in the App are automatically generated by artificial intelligence models and are provided only for language learning, expression practice, and reference purposes.
AI-generated content may be inaccurate, incomplete, inappropriate, inconsistent with the image content, or not meet your expectations. The App does not guarantee the accuracy, completeness, legality, suitability, or fitness for any particular purpose of AI-generated content.
Users should independently evaluate and reasonably use AI-generated content, and must not use AI-generated content for illegal or non-compliant purposes, infringement, commercial misrepresentation, professional decision-making, or other inappropriate purposes.
If AI-generated content involves illegal, non-compliant, infringing, inappropriate, or other risky content, the App may choose not to display it, delete it, restrict access to it, or take other necessary measures.
6. Third-Party Services
To implement image recognition, content generation, content safety review, data storage, login authentication, payment settlement, and other functions, the App may integrate third-party services, including but not limited to AI model services, content safety review services, cloud storage services, account login services, and in-app purchase services.
You understand and agree that your uploaded images, input content, AI-generated content, and necessary device, log, account, and order information may be transmitted to relevant third-party service providers for processing to the extent necessary to implement the above functions.
You must not submit illegal, non-compliant, infringing, pornographic or vulgar, violent or terrorist, politically sensitive, rights-infringing, or third-party-platform-rule-violating content to third-party AI services or other third-party services through the App. If your violation causes a third-party service to restrict, suspend, or terminate related services of the App, or causes the App or the operator to assume liability, you shall bear the corresponding consequences.
Third-party services are provided and are the responsibility of the corresponding third parties. The availability, stability, security, processing rules, terms of service, and privacy policies of third-party services may be independently determined by those third parties. The App will select appropriate third-party services within a reasonable scope, but does not guarantee the continuous availability or processing results of third-party services.
7. Usage Quota, Purchases, and Paid Services
The App may provide free usage quota, consumable in-app purchases, memberships, or other paid services. Specific prices, benefits, validity periods, and usage rules are subject to the information displayed in the App and on the Apple App Store purchase page.
If the App provides consumable in-app purchases, such purchases are usually used to increase usage quota or redeem corresponding services. Once a consumable purchase item is consumed, it usually cannot be restored. Purchases or usage while not logged in may result in purchase records, remaining quota, or history records being unable to synchronize across devices or be restored after uninstalling the App.
If you purchase relevant services through the Apple App Store, payment, refunds, billing, taxes, and related matters are usually handled by Apple according to its rules. You should comply with Apple’s relevant service terms and payment rules.
If benefit issuance or display is abnormal due to network issues, third-party service failures, App Store order delays, user device abnormalities, or other reasons, you may contact us through the contact method specified in these Terms. We will make reasonable efforts to assist after verification.
8. User-Uploaded Content and Intellectual Property
Images uploaded by users and the lawful rights contained therein belong to the users or original rights holders. The App does not obtain ownership of such images merely because you upload them.
To provide the App’s functions, you grant the App the right to store, transmit, process, display, generate, review, and synchronize your uploaded images, input content, and generated results within the scope necessary to provide the services.
You should ensure that the images and related content you upload or use have lawful sources or necessary authorization and do not infringe upon any third party’s portrait rights, privacy rights, reputation rights, copyright, trademark rights, personal information rights, or other lawful rights and interests. You shall bear responsibility for disputes, complaints, claims, or legal liabilities arising from your uploaded or used content.
The App’s name, interface, design, text, graphics, code, functional logic, trademarks, logos, and other content provided by the operator, except for parts legally owned by third parties, are owned by the operator or corresponding rights holders. Without permission, you may not copy, modify, distribute, rent, sell, reverse engineer, or otherwise use App content.
9. Data Storage and Deletion
The App may store your uploaded images, AI-generated content, history records, account information, usage quota, order records, log information, and other data to provide core functions, history record viewing, account synchronization, order verification, content safety, and service stability.
You may use the deletion function in the App or request deletion through the contact method specified in these Terms. We will process your request within a reasonable period after verifying your identity and request, except where laws and regulations provide otherwise, or where retention is necessary to fulfill compliance obligations, handle disputes, ensure security, or retain necessary records.
If you delete your account, the App will process cloud data associated with the account in accordance with the Privacy Policy and in-App instructions. After account deletion, relevant cloud history records, synchronized data, certain benefits, or services may not be recoverable. Data stored locally on your device may need to be deleted by you in the device or cleared by uninstalling the App.
10. Service Interruption, Changes, and Termination
The App may change, interrupt, restrict, or terminate some or all services due to product adjustments, technical maintenance, system upgrades, network failures, changes in third-party services, laws and regulations, regulatory requirements, or other reasons.
We will make reasonable efforts to ensure service stability, but do not guarantee that the service will be uninterrupted, error-free, or always meet all your needs.
If you violate these Terms, laws and regulations, or third-party service rules, the App has the right to restrict, suspend, or terminate services provided to you, and may take the measures specified in these Terms as appropriate.
11. Disclaimer
The App is provided on an “as is” and “as available” basis. Except as expressly required by laws and regulations, the App makes no express or implied warranties regarding the continuity, accuracy, completeness, timeliness, security, suitability, or error-free operation of the services.
You understand and agree that, to the extent permitted by law, the App shall not be liable for losses or risks caused by:
(1) users uploading, using, or distributing illegal, non-compliant, infringing, or inappropriate content;
(2) AI-generated content being inaccurate, incomplete, inappropriate, or not meeting expectations;
(3) users misusing, relying on, or improperly using AI-generated content;
(4) abnormalities in user devices, networks, systems, accounts, app stores, or third-party services;
(5) force majeure, regulatory requirements, changes in laws and regulations, or other reasons not reasonably controllable by the App.
12. Use by Minors
The App does not actively provide services to children under the age of 14. Minors should use the App with the consent and guidance of their parents or other guardians.
Guardians should reasonably guide minors to use the App correctly and safely and assume guardianship responsibility for minors’ use of the App. If you are a minor, please do not upload images containing your own or others’ private, sensitive, or inappropriate content.
13. Modification of These Terms
We may modify these Terms based on product functions, laws and regulations, regulatory requirements, or operational needs. After these Terms are updated, we will notify users through in-App prompts, page announcements, or other reasonable methods.
If you continue to use the App after the Terms are updated, you are deemed to have read, understood, and agreed to the updated Terms. If you do not agree to the updated content, please stop using the App.
14. Governing Law and Dispute Resolution
The formation, performance, interpretation, and dispute resolution of these Terms shall be governed by the laws and regulations of the People’s Republic of China, excluding conflict of law rules.
Any dispute arising from these Terms or the use of the App shall first be resolved through friendly negotiation. If negotiation fails, either party may bring a lawsuit before a competent people’s court in accordance with law.
